By accessing or using the Site, as well as our service channels (including WhatsApp and email), you accept these Terms of Use in their entirety. If you do not agree, you should not use our services.
EG ASSIST operates exclusively as a digital channel, intermediary, and marketer of international assistance plans. Under no circumstances does EG ASSIST directly provide medical services, clinical or hospital diagnoses, nor does it act as an insurance company. The coordination and execution of medical assistance are the sole and exclusive responsibility of the allied international assistance centers and their global network of providers. Consequently, any complaint, claim, or liability derived from medical negligence, malpractice, or problems in the provision of health services must be directed to the corresponding service provider, and EG ASSIST will not be liable nor indemnify for such acts.
For the acquisition of our plans, management of medical assistance, or affiliation as a Partner, EG ASSIST facilitates the reception of sensitive documents (such as photographs of passports, identity documents, forms, and/or medical care supports or medical prescriptions). You declare and guarantee that the documents and information provided through these channels are truthful and legal. EG ASSIST expressly acknowledges that these documents DO NOT constitute public content or creative works (User Content). Under no circumstances will EG ASSIST claim intellectual property rights, copyrights, or licenses to publicly display, commercialize, or freely distribute your identity documents or medical history. All information and documentation received via any digital means will be considered “Personal and Confidential Information,” will be protected through strict security protocols, and will be treated in accordance with our Privacy and Personal Data Processing Policy. Although EG ASSIST has secure and encrypted channels for document uploading, the User acknowledges that the voluntary sending of sensitive information through third-party messaging applications (such as WhatsApp) is done at their own risk. EG ASSIST commits to moving such information to its secure systems and deleting files from chats within a reasonable time, but does not guarantee the end-to-end security of platforms beyond its direct control.
To use certain features of the Site (such as the Partners dashboard), you may need to register and create an account. You are solely responsible for maintaining the confidentiality of your credentials. The Company will not be liable for any loss or damage arising from your failure to protect your account. You are granted a non-transferable, non-exclusive, and revocable license to use the Site solely for lawful personal and commercial purposes linked to our services.
In compliance with global regulations, the user guarantees that the funds used to acquire our services come from lawful sources and that they are not on restrictive or binding lists, such as the US Treasury’s OFAC list, or the UN list. Likewise, operating under US and international standards, it is prohibited to give, promise, offer, or receive bribes or irregular benefits to obtain commercial advantages (FCPA Law). EG ASSIST reserves the right to immediately terminate services and accounts if it detects non-compliance in this matter.
TO the MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EG ASSIST, ITS TECHNOLOGY PROVIDERS, AND ITS AFFILIATES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFITS, LOSS OF DATA, OR FOR INDIRECT, INCIDENTAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OR INABILITY TO USE THIS WEBSITE OR OUR DIGITAL CHANNELS (E.G., SERVER CRASHES, OR SYSTEM INTERRUPTIONS). NOTABLY, OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGE ARISING EXCLUSIVELY FROM THE USE OF THE WEB PLATFORM SHALL BE LIMITED TO A MAXIMUM OF FIFTY UNITED STATES DOLLARS ($50.00 USD) OR THE AMOUNT YOU HAVE PAID TO THE COMPANY FOR THE TECHNOLOGICAL TRANSACTION IN DISPUTE. THIS LIMITATION APPLIES ONLY TO THE OPERATION OF THE E-COMMERCE AND THE WEB, AND DOES NOT MODIFY THE COVERAGE LIMITS STIPULATED IN YOUR ASSISTANCE POLICY.
YOU AND EG ASSIST AGREE THAT ANY CLAIM OR DISPUTE SHALL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
Any controversy, dispute, or claim arising from or strictly related to the technological use of this Website, the e-commerce platform, or these Terms of Use, shall be governed by and construed in accordance with the laws of the State of Delaware, United States, and shall be submitted to the jurisdiction of the competent courts in said State. Fundamental note: Controversies related to the collection of personal data, medical coverage, or the effective provision of assistance services, are independently governed by the laws of the Republic of Colombia and by the conflict resolution mechanisms detailed in the Privacy Policy and in the General Conditions of the EG ASSIST Service.
These Terms of Use, together with the Privacy Policy and the General Terms and Conditions of Service, constitute the entire agreement between EG ASSIST and the User. In the event of any discrepancy, contradiction, or ambiguity between the provisions of these Terms of Use and the General Terms and Conditions, the parties agree that the provisions of the General Terms and Conditions shall prevail in all matters relating to the description, limits, scope, and execution of medical assistance coverage. Regarding matters related to the operation of the technological platform, e-commerce, and website use, these Terms of Use shall prevail.
Since services are acquired through e-commerce platforms, and in strict accordance with the consumer protection regulations applicable to the provision of the service (Article 47 of Law 1480 of 2011 of the Republic of Colombia), the user has the right to withdraw from the purchase within five (5) business days following the transaction. This right shall apply solely and exclusively provided that the coverage period of the contracted assistance plan has not commenced and none of the services have been used. If this right is exercised in a timely manner, EG ASSIST shall refund the total amount paid without any deductions or withholdings.
The Site may contain links to third-party websites or payment gateways (e.g., Stripe). Such links are not under the control of EG ASSIST, and we are not responsible for their content or practices. By accessing them, the terms of such third party apply.
By accessing, browsing, and/or contracting the services offered through the brand’s website, I declare that I have read, understood, and accepted in their entirety the scope, characteristics, conditions, limitations, and possible effects derived from the use of said services. By reason of the foregoing, I exonerate and release the company EG ASSIST from all liability before any judicial or administrative authority, as well as before third parties, for any damages, losses, indemnities, claims, lawsuits, costs, expenses, or any other contingency that may arise, directly or indirectly, as a consequence of the use, application, or exploitation of the contracted services.
